¿Democracia deliberativa y judicialización de los derechos sociales?

Resumen

Este trabajo explora qué implica defender un concepto deliberativo de la democracia respecto a la aplicación judicial de los derechos sociales. Aquí se analizan críticamente y, en primer lugar, las dos ideas de democracia que suelen fundamentar las decisiones de los jueces en materia de derechos sociales: la visión pluralista y la “rousseauniana”. Luego de mostrar los problemas propios de ambos enfoques, esta reflexión se pregunta sobre los significados de partir de una noción deliberativa de la democracia al decidir sobre la puesta en práctica o no de los derechos sociales.
